A federal judge granted Norwegian Cruise Line Holdings Ltd’s (NYSE: NCLH) request to temporarily block a Florida law that prohibits companies from requiring customers and employees to provide proof of COVID-19 vaccination status.

In a nearly 60-page preliminary ruling issued Sunday night, US District Judge Kathleen Williams in the Southern District of Florida said that the state has failed to “provide a valid, evidentiary, factual or legal predicate” for banning vaccination proof.

Norwegian Cruise Line Holdings Ltd (NYSE: NCLH) is fighting a Florida state law that prevents businesses from requiring customers and employees to provide proof of a COVID-19 vaccination.

In a complaint filed Tuesday against Florida surgeon general Scott A. Rivkees, the Miami-based cruise line asked the US District Court for the Southern District of Florida to throw out the state’s ban and grant the cruise line a preliminary injunction that would enable it to confirm vaccination status when it resumes sailing next month.

A federal judge denied a request from the US Centers for Disease Control and Prevention (CDC) to keep its COVID-19-related public health measures for cruises in effective in Florida past July 18.

US District Judge Steven Merryday of the Middle District of Florida originally ruled against the CDC last month, issuing a preliminary injunction that will turn the agency’s conditional sailing order into non-binding recommendations on July 18.

Norwegian Cruise Line Holdings Ltd said on Tuesday it would begin sailing outside the United States from the Caribbean and Greek Isles in July, restarting trips after a year-long hiatus brought on by the COVID-19 pandemic.

The company had appealed to federal health authorities on Monday to allow sailing from U.S. ports following the U.S. Centers for Disease Control and Prevention’s (CDC) latest guidance to the industry, including the need for COVID-19 vaccinations.
