BATON ROUGE, Louisiana, -- The Louisiana Public Service Commission issued the following order (No. T-35112)involving Gravity Oilfield Services, LLC:

In re: Application for a Common Carrier Certicate of non-hazardous oilfield waste for disposal, statewide.

ORDER OF DISMISSAL

On , Gravity Oilfield Services. LLC ("GOS" or the "Applicant") filed an application for a Common Carrier Certificate, allowing for the transportation of non--hazardous oilfield waste for disposal, statewide. On , a status conference was held, at which a procedural schedule was established and a hearing date was set. On , GOS filed an unopposed motion requesting that the procedural schedule be suspended and that the hearing be continued without date. On , GOS filed an unopposed motion, stating that it declines to move forward with its application and requesting that Docket No. T--35112 be dismissed without prejudice.

This dismissal is prepared in accordance with Rule 56(d) of the Rules of Practice and Procedure of the Louisiana Public Service Commission. which provides:

Except at the discretion of the administrative law judge, the procedures contained within subpart (a) of this Rule shall not apply to a motion to dismiss jointly filed by all parties of record, a motion to dismiss with prejudice filed by the party who instituted the proceeding, or a motion to dismiss without prejudice filed by a party who instituted the proceeding but prior to the filing of an other part filing of a responsive pleading. Upon the filing of such a motion to dismiss, the administrative law judge may forego all recommendation procedures and prepare an appropriate order of dismissal for issuance by the Commission.

IT IS THEREFORE ORDERED:

That Docket Number T--35l 12 be. and hereby is, DISMISSED.
