A federal judge ruled Thursday that the U.S. government’s practice of denying migrants a chance to apply for asylum on the Mexican border until space opens up to process claims is unconstitutional.

U.S. District Judge Cynthia Bashant’s ruling has no immediate impact but could prevent the government from limiting entry for asylum-seekers because it says it lacks resources. It could also bring relief to some of the tens of thousands of people who put their names on unofficial waiting lists in Mexican border towns.

The Supreme Court says the Biden administration likely violated federal law in trying to end a Trump-era program that forces people to wait in Mexico while seeking asylum in the U.S.

With three liberal justices in dissent, the high court on Tuesday refused to block a lower court ruling ordering the administration to reinstate the program informally known as Remain in Mexico.

The U.S. government on Wednesday extended the closure of land borders with Canada and Mexico to non-essential travel such as tourism through Aug. 21 even as officials debate whether to require visitors to have received a COVID-19 vaccine.

The latest 30-day extension by the Department of Homeland Security (DHS) came after Canada said on Monday it would start allowing in fully vaccinated U.S. visitors on Aug. 9 for non-essential travel after the COVID-19 pandemic forced a 16-month ban that many businesses have called crippling.
