FERC Issues Letter Order Accepting Plainfield Renewable Energy, LLC's 5/16/14 Filing of Tariff Revisions and Request for Category 1 Status Under ER14-1976 WASHINGTON, June 26 -- The U.S. Department of Energy's Federal Energy Regulatory Commission issued the text of the following delegated order: In Reply Refer To: Plainfield Renewable Energy, LLC Docket No. ER14-1976-000 June 26, 2014 Mr. Scott D. Johnson Attorney for Plainfield Renewable Energy, LLC Akin Gump Strauss Hauer & Feld LLP 1333 New Hampshire Avenue, N.W. Washington, D.C. 20036 Reference: Tariff Revisions and Request for Category 1 Status Dear Mr. Johnson: On May 16, 2014, you filed on behalf of Plainfield Renewable Energy, LLC (Plainfield) a revised market-based rate tariff providing for revisions to reflect Plainfield's status as a Category 1 Seller in all regions; provide for the sale of ancillary services at market-based rates in the Southwest Power Pool, Inc. market; include the revised tariff language regarding third-party sales of ancillary services as adopted in Order No. 784; and complete the citation to the Commission order granting Plainfield's market-based rate application. In addition, you filed on behalf of Plainfield a request for Category 1 status representing that Plainfield meets the criteria for Category 1 status in all regions. You state that Plainfield owns or controls less than 500 megawatts of generation in the Northeast region and that neither Plainfield nor its upstream owners own or control generation in any other region; does not own, operate, or control transmission facilities other than limited equipment used to connect its facility to the ISO New England Inc. transmission grid; is not affiliated with any entity that owns, operates, or controls transmission facilities in any region; is not affiliated with a franchised public utility in any region; and does not raise any vertical market power issues. Your filing was noticed on May 16, 2014, with comments, protests or interventions due on or before June 6, 2014. None was filed. Pursuant to the authority delegated to the Director, Division of Electric Power Regulation - West, under 18 C.F.R. section 375.307, your submittal filed in the referenced docket is accepted for filing, effective May 17, 2014, as requested. Based on your representations, Plainfield meets the criteria as a Category 1 seller in all regions, and is so designated. This action does not constitute approval of any service, rate, charge, classification, or any rule, regulation, or practice affecting such rate or service provided for in the filed documents; nor shall such action be deemed as recognition of any claimed contractual right or obligation affecting or relating to such service or rate; and such acceptance is without prejudice to any findings or orders which have been or may hereafter be made by the Commission in any proceeding now pending or hereafter instituted by or against any of the applicant(s). This order constitutes final agency action. Requests for rehearing by the Commission may be filed within 30 days of the date of issuance of this order, pursuant to 18 C.F.R. section 385.713.
